SALMON RIVER TACTICS

Refund Policy

This Refund Policy outlines the terms and conditions for refunds on classes offered by Salmon River Tactics.

Student Cancellations:

  • 50% Refund: Students who cancel their participation in a class at least [2] days prior to the start of the class will receive a 50% refund of the class fee.
  • 0% Refund: Students who cancel within [1] days of the class start date or who fail to attend the class (no-show) will not be eligible for a refund.

Instructor Cancellations:

  • 100% Refund: In the event that Salmon River Tactics must cancel a class due to unforeseen circumstances (e.g., instructor illness, severe weather), students will receive a full 100% refund of the class fee.

Exceptions:

  • There may be exceptions to this policy at the sole discretion of Salmon River Tactics.
  • For private classes or custom packages, specific refund terms may apply and will be outlined in a separate agreement.

SALMON RIVER TACTICS 

LIABILITY WAIVER AND RELEASE OF CLAIMS

Agreement

This Liability Waiver and Release of Claims (“Agreement”) is made and entered into this [DATE] by and between Salmon River Tactics, a [NEW YORK] [DOING BUSINESS AS] with a principal place of business at [3920 US 11 PULASKI, NY 13142] (“Salmon River Tactics”), and [PARTICIPANT NAME] (“Participant”).

Acknowledgment of Risks

Participant acknowledges that participation in the activities offered by Salmon River Tactics, including but not limited to [Firearms instruction, survival instruction, outdoor recreation, etc …] (“Activities”), involves inherent risks and dangers, including but not limited to:

  • Natural Hazards: Weather conditions (e.g., extreme heat, cold, rain, snow, wind, storms), uneven terrain, falling rocks, wildlife encounters, water hazards (e.g., currents, rapids, hypothermia), and other natural occurrences.
  • Activity-Related Risks: Risks associated with the specific activities, such as [Tripping, falling, equipment failure, injury from other participants, exposure to the elements, misuse of equipment].
  • Guide/Instructor Risks: The possibility of errors in judgment or instruction by Salmon River Tactics’ personnel or instructors.
  • Participant Risks: Risks arising from the Participant’s own actions, including but not limited to:
  • Failure to follow instructions.
  • Lack of physical fitness or experience.
  • Assumption of unreasonable risks.
  • Use of alcohol or drugs.
  • Failure to use safety equipment properly.

Assumption of Risk and Release of Claims

In consideration of the opportunity to participate in the Activities, Participant hereby agrees to the following:

  1. Assumption of Risk: Participant expressly assumes all risks associated with participation in the Activities, whether known or unknown, foreseeable or unforeseeable.
  2. Release of Claims: Participant hereby releases, waives, discharges, and covenants not to sue Salmon River Tactics, its owners, employees, agents, contractors, guides, instructors, and all other persons or entities acting on its behalf (collectively, “Released Parties”) from any and all claims, demands, actions, causes of action, damages, losses, liabilities, costs, and expenses of any kind (including, but not limited to, medical expenses, lost wages, and attorney’s fees), whether known or unknown, arising out of or in any way connected with Participant’s participation in the Activities, including but not limited to:
  • Negligence of the Released Parties.
  • Breach of contract by the Released Parties.
  • Any other act or omission of the Released Parties.
  1. Indemnification: Participant agrees to indemnify and hold harmless the Released Parties from any and all claims, demands, actions, causes of action, damages, losses, liabilities, costs, and expenses arising out of or in any way connected with Participant’s participation in the Activities, including but not limited to those caused by Participant’s own negligence or the negligence of any other person or entity for whom Participant is legally responsible.

Other Provisions

  • Insurance: Participant acknowledges that Salmon River Tactics may carry insurance, but such insurance may have limitations or exclusions that may affect Participant’s ability to recover damages.
  • Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the State of [New York].
  • Severability: If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
  • Entire Agreement: This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written.
